Try Bimaclaimo

Bimaclaimo drafts letters from the information you give, using publicly available IRDAI and US rules. It is not a law firm, does not give legal or medical advice, and does not file or represent you. Check every fact and clause before sending; for fraud allegations, large amounts or court cases, consult a lawyer.

Free claim rejection decoder and deadline planner

Pick the reason on your letter to see whether it is usually winnable, the rules on your side, the documents to collect and your last dates. No sign-up.

What it means

The insurer says the illness existed before the policy started, or that you did not declare something in the proposal form.

Often winnableRejections on this ground are often reversed when the appeal answers it with the right documents.

Rules on your side

  • For policies under the 2024 IRDAI rules, a PED is a condition diagnosed or treated by a doctor within 36 months before the first policy started, and the PED waiting period can be at most 36 months.
  • Moratorium: after 60 continuous months of cover (porting and migration count), a claim cannot be contested for non-disclosure or misrepresentation except proven fraud.
  • The undisclosed condition should be connected to the illness claimed. Courts have repeatedly refused repudiation over an unrelated or unknown past condition.

Collect before you appeal

  • Copy of your proposal form (ask the insurer for it in writing)
  • All earlier policies and renewal notices, including the ones you ported from
  • Treating doctor's certificate on when the illness started and that it is unrelated to the old condition

Your next steps and last dates

  1. 1. Written grievance to the insurer's Grievance Redressal Officer

Send now, by email, with documents. Insurers are expected to resolve grievances within 14 days.

  2. 2. Insurance Ombudsman

Opens if the insurer rejects your grievance or does not reply within 30 days of it. Then you have 1 year.

  3. 3. Consumer Commission

Within 2 years of the repudiation.

Room rent proportionate deduction checker (India)

Took a room above your limit and the insurer cut the whole bill? Check the most it is allowed to deduct.

Enter the room limit, the room rent charged and the days to see the most the insurer can deduct.

Per IRDAI rules, proportionate deduction cannot be applied to pharmacy and consumables, implants and medical devices, diagnostics, or ICU charges, nor where the hospital charges the same rate for every room type. Some policies have no room limit at all - check your policy schedule. This is an estimate based on the figures you enter.

5 rules for an appeal that gets a claim paid

  1. Get the reason in writing

Ask for the repudiation letter quoting the exact policy clause, and the itemised deduction sheet. You cannot rebut a reason you have not seen.

  2. Answer the clause, not the feeling

Quote the insurer's words, then the policy definition and the IRDAI rule that answers it. Angry letters get template replies.

  3. Let the treating doctor speak

A one-page certificate from the treating doctor on why admission was needed, or when the illness started, is the strongest document in most health claim disputes.

  4. Use every free step in order

Grievance officer, then Bima Bharosa or the Insurance Ombudsman (free, up to ₹50 lakh). In the US: internal appeal, then external review. Each step needs the previous one in writing.

  5. Keep the paper trail

Email, not phone. Save every acknowledgement and complaint number - the Ombudsman and the external reviewer will ask for them.

Bimaclaimo builds all five into every appeal: the clause-by-clause rebuttal, the doctor's certificate draft, the escalation letter and the documents list for your case.

Free error checker and deadline tracker

Pick what is wrong on your report to see if a dispute can fix it, who must correct it and what proof to collect. Add your dispute date to see your deadlines and, in India, the ₹100/day compensation you are owed. No sign-up.

Usually fixable by a dispute if it is wrong

What it means: An account under your name or PAN that you never opened. Either the lender mixed up two customers or someone used your documents (identity fraud).

Who to write to: The bureau (ownership dispute) and the lender's grievance / nodal officer. If it looks like fraud, also report it at cybercrime.gov.in or helpline 1930 and attach the acknowledgement.

Evidence to collect

  • PAN and Aadhaar (masked) to prove who you are
  • Written statement that you never applied
  • Police / cybercrime complaint number if it is fraud
  • Screenshot of the account line in the report

Ask the lender for a copy of the loan application and KYC used. If it isn't yours, they cannot keep reporting it against you.

The dispute ladder, step by step

India: CIBIL, Experian, Equifax, CRIF High Mark

  1. Get your full report

Each bureau (TransUnion CIBIL, Experian, Equifax, CRIF High Mark) gives one free full report a year. Lenders report to all of them, so check each one: an error can sit on one bureau only.

  2. Dispute with the bureau and write to the lender (day 0)

Raise the dispute on the bureau's website and save the dispute ID. On the same day, email the lender's grievance or nodal officer with your proof, because only the lender can change what it reported.

  3. Lender's deadline (day 21)

Under RBI's compensation framework the lender gets 21 days to send corrected data to the bureau, and the whole complaint must be resolved within 30 days.

  4. Claim ₹100 per day (after day 30)

If it isn't fixed in 30 calendar days, you are owed ₹100 for each extra day, paid by whoever caused the delay, into your bank account within 5 working days of resolution.

  5. RBI Ombudsman

Rejected, ignored or no compensation paid: file a free complaint at cms.rbi.org.in against the lender or the bureau. Both are covered by the RBI Integrated Ombudsman Scheme.

USA: Equifax, Experian, TransUnion

  1. Pull all three reports

Free every week at AnnualCreditReport.com. Note each wrong item, the account number and which bureaus show it.

  2. Dispute with each bureau (section 611) and the furnisher (section 623)

Send a written dispute with copies of your proof. Certified mail with return receipt gives you a dated record. Identity theft: use a section 605B block with an FTC Identity Theft Report instead.

  3. 30 days (sometimes 45)

The bureau must investigate and send results within 5 business days of finishing. Items it can't verify must be deleted or corrected.

  4. Verified anyway? Ask how

Request the method of verification (section 611(a)(7)); the bureau must describe it within 15 days. Add a 100-word statement of dispute if needed.

  5. CFPB complaint, then a lawyer

File at consumerfinance.gov/complaint. The FCRA lets you sue for willful or negligent violations and recover attorney fees, so many consumer lawyers take strong cases with no upfront fee.

Bimaclaimo writes the paperwork for each step: the bureau dispute, the lender letter, the compensation claim and the Ombudsman or CFPB complaint.

Never do this

  • Pay anyone who promises to remove correct negative entries. Only the lender can change what it reported, and accurate data stays.
  • In the US, pay a credit repair company before it has done the work. The Credit Repair Organizations Act bans upfront fees.
  • Send original documents. Send copies and keep the originals.
  • Dispute everything at once with copy-paste letters. Bureaus can treat those as frivolous; specific disputes with proof get fixed.

Free: will the bank have to pay you back? (RBI liability calculator)

Answer three questions to see your maximum liability under RBI's rules for unauthorised transactions, and the dates your bank must meet. No sign-up.

How did it happen?

Enter both dates to see your limit

Third-party breach: zero liability if reported within 3 working days of the bank's SMS/email; capped between 4 and 7 working days; bank's policy after that.

Based on RBI circular DBR.No.Leg.BC.78/09.07.005/2017-18 (6 July 2017). Working days skip Sundays and 2nd/4th Saturdays but not public holidays, so check against your home branch's holiday list. This is a guide, not legal advice; your bank's written policy and the facts decide the final outcome.

Lost money just now? The first hour

  1. Call 1930 or file at cybercrime.gov.in

Choose Report Cyber Crime > Financial Fraud. The alert reaches the banks involved and is how money gets held before it is withdrawn. Write down the acknowledgement number.

  2. Block card, UPI and net banking

Use the number on the back of your card, your bank's app or its official website - never a 'customer care' number from a Google search or a caller.

  3. Report to your bank in writing, today

Email or the bank's fraud form, with every transaction ID. This date starts the RBI clock: 3 working days for zero liability on unauthorised debits.

  4. Cut off the fraudster

Uninstall any app they asked you to install, change UPI PIN, net banking and email passwords from another phone, and log out of other devices.

  5. Save evidence before deleting anything

Screenshots of chats, call log, SMS alerts, UPI IDs, websites, app names, bank statement. Report the number on Chakshu (sancharsaathi.gov.in).

Nobody from the police, RBI, a court or a "recovery agency" will ask you for a fee to get your money back. Calls offering that after a fraud are usually a second scam.

"Amount frozen" - how the money actually comes back

  1. The 1930 / portal alert makes the receiving bank put a hold (lien) on the amount still in the fraudster's account.
  2. Police verify your claim and the money trail, and you receive the details of the hold from the investigating officer or your bank.
  3. A Judicial Magistrate orders the release on your application under section 503 BNSS (formerly 457 CrPC). Some courts ask for an indemnity bond; some states also release money through Lok Adalats.
  4. The investigating officer sends the order to the bank, which credits the amount to your account.

The hold alone does not return your money. Bimaclaimo drafts the release application, the bank letter and the police complaint for your case, so you can file them yourself or hand them to a lawyer.

Insurers, banks and credit bureaus count on you giving up. A claim rejected for 'pre-existing disease', a loan shown as overdue that you closed years ago, or ₹40,000 gone in a UPI scam each has a fixed escalation ladder with strict deadlines: the grievance cell, then the Insurance or RBI Ombudsman, then the consumer court. Most people never get past step one because they don't know the rules the other side must follow.

  • Health and life claim appeals that answer each rejection reason with the policy clause and IRDAI rules
  • CIBIL, Experian and Equifax disputes plus the lender letter and the ₹100-a-day RBI compensation claim
  • UPI, card and net-banking fraud: the bank letter under the RBI zero-liability rules, the 1930 / cybercrime.gov.in complaint and the release application
  • The exact deadline for each step, worked out from your dates
  • Insurance and Banking Ombudsman complaints when the first reply is a no
  • US claims and credit reports too (CFPB, state insurance department)

Straight answers

Can a rejected health insurance claim really be reversed?

Often, yes. Many rejections rest on reasons that IRDAI rules limit: 'hospitalisation not required' against the treating doctor's advice, pre-existing disease claims beyond the 36-month look-back or after 60 months of continuous cover, or proportionate deductions on medicines and tests. A written grievance that answers each reason with the policy wording and documents, followed by the Insurance Ombudsman if needed, gets many such claims paid. Some rejections are correct (a genuine exclusion or an undisclosed related illness) and the draft tells you honestly when that is likely.

What do I do first after a claim rejection?

Ask for the rejection reason and deduction sheet in writing, then send a grievance by email to the insurer's Grievance Redressal Officer (the address is on the insurer's website and policy). Insurers are expected to resolve grievances within 14 days. If they reject it or don't reply within 30 days, you can go to the Insurance Ombudsman within 1 year.

What is the Insurance Ombudsman and does it cost anything?

It is a free forum for disputes with insurers in India, for claims up to ₹50 lakh. You file online at cioins.co.in with the office covering your address, after first complaining to the insurer. If you accept its award, the insurer must comply. You don't need a lawyer.

The insurer says 'pre-existing disease' but I declared everything. What now?

Ask for a copy of your proposal form. If you declared the condition, or the illness claimed is unrelated, or the policy has been running for 60 continuous months (counting ported policies), the rejection is weak. The draft builds the rebuttal and a doctor's certificate on when the illness started.

My room was above the limit and they cut the whole bill. Is that allowed?

Only partly. Proportionate deduction may apply to 'associated' charges like doctor and nursing fees, but not to medicines and consumables, implants, tests or ICU charges. Use the free checker on this page to see the most the insurer could deduct.

Does it work for US health insurance denials?

Yes. Choose USA. You get an internal appeal letter that answers the plan's criteria and asks for your claim file, a letter of medical necessity draft for your doctor, and the external review request with deadlines (180 days to appeal, 4 months for external review). Medicare and Medicaid have different steps; the draft notes that if your plan is one of those.

How much does it cost?

₹149 in India or $3 elsewhere for one case: the full appeal pack (letter, doctor's certificate, documents list and deadlines) with 3 revisions, for example to add the clause number once you find it or to write the Ombudsman complaint next. The decoder, deadline planner and deduction checker are free.

Will you send it to the insurer or represent me?

No. You send the letter yourself by email or on the portal. For fraud allegations, very large claims or court cases, use a lawyer - the draft says when.

Is my medical information safe?

Share only what the letter needs. You can replace names and policy numbers with placeholders and fill them in after downloading.

How long does CIBIL take to correct an error?

Under RBI's compensation framework, a credit information complaint must be resolved within 30 calendar days of filing. The lender gets 21 days to send corrected data to the bureau and the bureau the rest. After the bureau updates the record, your score can take a few more days to refresh.

Can I really get ₹100 per day if it isn't fixed in 30 days?

Yes. RBI's framework (circular of 26 October 2023, in force since April 2024) gives ₹100 per calendar day beyond 30 days. The lender pays if it didn't send the correction within 21 days, otherwise the bureau pays, and it must reach your bank account within 5 working days of resolution. If it is refused, you can complain to the RBI Ombudsman. Bimaclaimo's escalation mode works out the amount from your dates and writes the claim.

My account says 'Settled' but I paid in full. Can it be changed to 'Closed'?

Yes, if you really paid the full dues: send the lender your NOC and payment proof and dispute it with each bureau. If you did a one-time settlement for less, 'Settled' is accurate and a dispute will be rejected. The honest fix is to pay the waived amount, get a fresh NOC saying 'closed' and ask the lender to update the bureaus. The tool tells you which case you're in.
